VEXATIOUS LITIGANT

Text: Vexatious Litigants This Web site is designed for the courts and the public to find useful information about vexatious litigants. Code of Civil Procedure section 391.7(e) requires the Judicial Council to maintain a list of vexatious litigants. The council has delegated the responsibility of maintaining the list to its staff agency, the Administrative Office of the Courts (AOC). Publication of the vexatious litigant list began in 1991. Only orders filed from 1991 to the present are included on the list. The clerk of the court provides to the Judicial Council a copy of any issued prefiling orders. If you think someone whose name is not on the list may be a vexatious litigant, you may want to check with the individual court to see if there is an order for this person or organization. Code of Civil Procedure section 391(b) provides the definitions of vexatious litigants. The Judicial Council is required to disseminate the vexatious litigant list to the court clerks annually. The council has no discretion in maintaining the list, nor does it have the authority to remove a name from the list. In order to remove a name from the vexatious litigant list, the council must receive an order directly from the issuing court vacating the prefiling order.
